VLC 1.0.0 H264 wrong level

I'm using the exact same settings for x264 with VLC 1.0.0 release as the ones I used with VLC 1.0.0-pre2, one of these settings being the H264 level which is set to 4.1.

VLC 1.0.0-pre2 gave me the correct level I asked for: {{{ Format : MPEG-4 Format profile : Base Media Codec ID : isom Writing application : vlc 1.0.0-pre2-20090430-2310 stream output Comment : QuickTime 6.0 or greater

Source file is the same MPEG2 PAL DVB capture. Output size is the same. And as I've said x264 settings are the same in both cases.
